September 23, 2019 Opinion or Order Filing 2 ORDER that this matter comes before the Court on the plaintiff's motion to proceed in forma pauperis. (Dk. No. #1 .) Upon due consideration, the Court FINDS the plaintiff unable to pay the costs of proceeding in this case. Accordingly, the Court GRANTS the plaintiff's motion and DIRECTS the Clerk to docket the complaint. For the reasons set forth below, however, the Court DISMISSES the complaint WITH PREJUDICE pursuant to 28 U.S.C. 1915(e)(2)(B)(i) (please see Order for additional information.) Because Ruther's complaint is legally frivolous, the Court DISMISSES this case WITH PREJUDICE. Additionally, pursuant to 28 U.S.C. 1915(a)(3), the Court CERTIFIES that an appeal in forma pauperis would not be taken in good faith, and therefore, the Court revokes Ruther's in forma pauperis status for appellate purposes.
