ORDER - This matter comes before the Court after being transferred from the United States District Court for the Southern District of New York (ECF No. 3) and upon Plaintiffs Request to Proceed informa pauperis (ECF No. 1) filed pursuant to 28 U.S.C. l 915(a). Upon due consideration, Plaintiffs Request (ECF No. 1) is hereby GRANTED. Plaintiff may proceed in this case without paying the Court's filing fee. Plaintiffs Complaint (ECF No. 2) is hereby deemed FILED as of the date of this Order. The Clerk is DIRECTED to issue process and deliver the summons to the United States Marshal for service. The Clerk of Court is further directed to transfer this action to the United States District Court for the Eastern District of Virginia. Whether Plaintiffs should be permitted to proceed further without prepayment of fees is a determination to be made by the transferee court. A summons shall not issue from this Court. This order closes this case. The Court certifies, pursuant to 28 U.S.C 1915(a)(3), that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
