MEMORANDUM ORDER that Plaintiff, a Virginia prisoner proceeding pro se, filed this civil action. By Memorandum Opinion and Order entered on July 17, 2020, the Court dismissed the action because failed to return a completed in forma pauperis affidavit form and a consent to collection of fees form. See Fed. R. Civ. P. 41(b). On July 29, 2020, the Court received a completed consent to collection of fees form and an in forma pauperis affidavit, that Plaintiff signed on July 22, 2020. Plaintiff offers no explanation for his tardy filing of these forms. Nevertheless, because Plaintiff returned the forms, it appears that Plaintiff desires to continue to pursue his claims. Accordingly, the Clerk is DIRECTED to refile Plaintiff's Complaint (ECF No. 1 ) as a new civil action as of the date of entry hereof. The Clerk SHALL file a copy of this Memorandum Order in the new civil action. Plaintiff will be required to resubmit any forms as directed by the Court. It is so ORDERED. Signed by District Judge M.
