ORDER. Because the defendant timely filed its motion to dismiss, the Court DENIES the plaintiff's request, (Dk. No. #6 ). The Court GRANTS the defendant's motion and dismisses the action without prejudice. The plaintiff may appeal this Order. To do so, the plaintiff must file a written notice of appeal with the Clerk of the Court within thirty (30) days of the entry of this Order.
