ORDER that on December 23, 2020, Plaintiff filed a Motion to Withdraw Filing and Motion to Withdraw as Counsel. (ECF No. #6 .) In her Motion, Plaintiff seeks to "withdraw the Complaint filed in the matter." (ECF No. #6 .) The Court interprets Plaintiff's Motion (ECF No. #6 ) as a notice of dismissal. Because Defendant has neither filed an answer nor a motion for summary judgment, Plaintiff's notice operates to dismiss the action without further action from the Court. Fed. R. Civ. P. 41(a)(1)(A)(i). Accordingly, the action is DISMISSED WITHOUT PREJUDICE. Further, given the dismissal, Plaintiff's Motion to Withdraw as Counsel (ECF No. #6 ) is MOOT. It is so ORDERED.
