August 17, 2021 Opinion or Order Filing 10 MEMORANDUM ORDER (DISMISSING ACTION). The Court hereby FINDS that Plaintiff's Complaint (ECF No. #3 ) fails to satisfy Federal Rule of Civil Procedure 8, which requires a short and plain statement of the grounds for this Court's jurisdiction and a short and plain statement of the claims showing that a plaintiff is entitled to relief. Consequently, the provisional grant of relief to proceed in forma pauperis is hereby WITHDRAWN and the Motion for Leave to Proceed in forma pauperis DENIED. The Court hereby DISMISSES WITHOUT PREJUDICE Plaintiff's Complaint pursuant to Federal Rule of Civil Procedure 41(b). Accordingly, the Court hereby DENIES AS MOOT the various Motions that Plaintiff has filed in this case (ECF Nos. #4 , #5 , #6 , #7 , #8 , and #9 ). Furthermore, based on the Complaint's failure to state a claim, the Court certifies that an appeal in forma pauperis would not be taken in good faith pursuant to 28 U.S.C. 1915(a)(3). Thus, Plaintiff's in forma pauperis status is hereby REVOKED for the purpose of appeal. Should Plaintiff wish to appeal this Order, written notice of appeal must be filed with the Clerk within thirty (30) days of the date of entry hereof. Failure to file a notice of appeal within the stated period may result in the loss of the right to appeal. See Order for complete details. This case is now CLOSED. It is so ORDERED. July 2, 2021 Opinion or Order Filing 2 ORDER that this matter comes before the Court on Plaintiff Jacob Queern's ("Plaintiff') #1 Motion for Leave to Proceed in forma pauperis and Complaint (ECF No. 1-1). The Court finds Plaintiff qualified to proceed in forma pauperis and, therefore, the Court hereby conditionally GRANTS the Motion for Leave to Proceed in forma pauperis. It is hereby ORDERED that, within twenty-one (21) days of this Order, Plaintiff shall file a particularized amended complaint that outlines in simple and straightforward terms why Plaintiff thinks that he is entitled to relief and why the Court has jurisdiction over this case, pursuant to Federal Rule of Civil Procedure 8(a)(1) and (2). The failure to strictly comply with the Court's directive and with applicable rules will result in DISMISSAL of this action for failure to prosecute under Federal Rule of Civil Procedure 41(b).
