Filing 2 MEMORANDUM ORDER (Granting Plaintiff's Motion to Proceed In Forma Pauperis and Dismissing the Case) - THIS MATTER is before the Court on prose Plaintiff Frank Brett's ("Plaintiff') application to proceed informa pauperis, filed on September 29, 2021. (ECF No. 1.) The Court concludes Plaintiff is unable to pay the Court's filing fees. Therefore, Plaintiffs application to proceed informa pauperis is hereby GRANTED, and Plaintiff may proceed without paying the Court's filing fee. The Court DIRECTS the Clerk to file Plaintiffs Complaint in this case. For the reasons set forth below, however, the Court finds that the allegations within the Complaint are wholly incredible, and therefore, the Court will dismiss Plaintiff's Complaint pursuant to 28 U.S.C. 1915(e)(2)(B)(i). Plaintiffs Complaint (ECF No. 1) is DISMISSED WITHOUT PREJUDICE. Plaintiff is free to augment the factual and legal bases upon which his claim rests and refile with this Court. Furthermore, the Court certifies that an appeal informa pauperis would not be taken in good faith pursuant to 28 U.S.C. 1915(a)(3), and therefore, Plaintiffs informa pauperis status is hereby revoked for the purpose of appeal. Should Plaintiff wish to appeal this Order, written notice of appeal must be filed with the Clerk of Court within thirty (30) days of the date of entry hereof. SEE ORDER FOR DETAILS.
