ORDER This matter comes before the Court on the parties joint motion to deem the defendants partial motion to dismiss moot and extend the time for responding to the forthcoming amended complaint. (ECF No. #16 .) The Court GRANTS IN PART the motion and STAYS the deadline for the plaintiff to respond to the defendants motion to dismiss. (Id.) Under Federal Rule of Civil Procedure 15(a) (1)(B), the plaintiff may file an amended complaint on or before February 21, 2022. If the plaintiff files an amended complaint, the defendant SHALL respond to the amended complaint within 21 days of the date the amended complaint is filed.
