Filing 4 MEMORANDUM ORDER (Granting Plaintiff's Motion to Proceed In Forma Pauperis and Dismissing Complaint) The Court concludes that Plaintiff is unable to pay the Court's filing fees. Therefore, Plaintiffs application to proceed in forma pauperis is hereby GRANTED, and Plaintiff may proceed without paying the Court's filing fee. The Court directs the Clerk to file Plaintiffs Complaint in this case. For the reasons set forth, however, the Court finds that Plaintiffs Complaint fails to state a claim upon which relief may be granted. Accordingly, the Court dismisses Plaintiffs Complaint pursuant to 28 U.S.C. 1915(e)(2)(B)(i) but will allow Plaintiff leave to amend. Because Plaintiff has not adequately pled a cognizable claim, the Court will deny Plaintiffs Motion to Appoint of Counsel. For these reasons, Plaintiff's Complaint is DISMISSED WITHOUT PREJUDICE. However, the Court believes Plaintiff deserves another attempt to amplify the factual and legal bases upon which his claim rests. Therefore, the Court will allow Plaintiff leave to file an amended complaint within thirty (30) days of the entry of this Memorandum Order. However, Plaintiff is warned that failing to file an amended complaint that complies with the Federal Rules of Civil Procedure may result in the dismissal of his action with prejudice.
