ORDER (Granting Application to Proceed In Forma Pauperis, Directing Service and Remanding Claim). This matter comes before the Court on Plaintiff's Amended Application to Proceed In Forma Pauperis ("IFP Application"), (ECF No. 3), and proposed Amended Complaint, (ECF No. 3-1).1 Upon review, the Court finds that Plaintiff is unable to pay the costs of proceeding and GRANTS his Motion. (ECF No. 3.) The Court hereby DIRECTS the Clerk to docket Plaintiff's Amended Complaint, issue process and deliver both the summons and a copy of this Order to the United States Marshal for service. Upon due consideration, the Court hereby REMANDS Plaintiff's 8 U.S.C. 1447(b) claim to U.S. Citizenship and Immigration Services to adjudicate Plaintiff Alberto Aguilar Jesus Pinzon's application for naturalization within seventy-five (75) days of the entry of this Order. The Court hereby STAYS the remainder of the case for ninety days. The Court further ORDERS that within seventy-five (75) days of receipt of service, Defendants shall file a Report apprising the Court of the status or resolution of Plaintiff's naturalization application. Should USCIS fail to adjudicate Plaintiff's application within that time, the Court will grant Plaintiff leave to file a motion for appointment of counsel pursuant to 28 U.S.C. 1915(e) and otherwise exercise its authority to decide the case pursuant to 8 U.S.C. 1447(b).
