Filing 5 DISMISSAL ORDER - The Court gave Plaintiff leave to Amend rather than dismissing the action outright, (ECF No. #2 ). Unfortunately, while the present Amended Complaint corrects some of those issues, Plaintiff did not address all the problems the Court identified, and accordingly the Court finds that once again, Plaintiff has failed to state a claim on which relief may be granted. In light of the foregoing, pursuant to 28 U.S.C. 1915(e)(2)(B), the Court ORDERS that the action be DISMISSED without prejudice. See Order for details. It is so ORDERED. Signed by District Judge Roderick C. Young on 4/13/2023. Order was mailed to the plaintiff. (sbea) |

Filing 2 ORDER TO SHOW CAUSE. Based on the financial information contained in Plaintiff's IFP Application, the Court is satisfied that Plaintiff qualifies for in forma pauperis status. Accordingly, Plaintiff's IFP Application, ECF No. #1 , is GRANTED, and the Clerk is DIRECTED to file Plaintiff's Complaint. However, Plaintiff's Complaint suffers from defects that must be addressed before this action may proceed, as they impact the Court's ability to hear this case. Plaintiff is ORDERED to SHOW CAUSE why this action should not be dismissed by filing an Amended Complaint within thirty (30) days from the date of entry of this Order to Show Cause. The Amended Complaint will supersede the initial Complaint and will become the operative complaint in this action. Plaintiff is ADVISED that this action may be dismissed if he fails to comply with the termsof this Order to Show Cause. Plaintiff is further reminded that, although he initiated this matter pro se, he has the option of retaining counsel to assist him with the pursuit of his claims. See Order for details. It is so ORDERED. Signed by District Judge Roderick C. Young on 3/23/2023. Order was mailed to the plaintiff. (sbea) |
