ORDER This matter comes before the Court on Defendants' Motion to Dismiss Plaintiffs Amended Complaint. (ECF #3 .) For the reasons stated in the accompanying Memorandum Opinion, the Court hereby GRANTS IN PART Defendants' Motion. (ECF #3 .) To the extent Plaintiff asserts a claim for discrimination and a claim under the Family Educational Rights and Privacy Act (FERP A), these counts are hereby DISMISSED WITHOUT PREJUDICE. To the extent Plaintiff asserts a claim against Defendants for failure to abide by Virginia Commonwealth University's internal reporting requirements, this suit is hereby REMANDED to the Circuit Court for the City of Richmond, Virginia. The case is now CLOSED. The Clerk is directed to notify all counsel of record and transmit a copy to Plaintiff and to the Circuit Court for the City of Richmond. Signed by District Judge David J.
