ORDER- This matter is before the Court on Plaintiff's Motion to Proceed In Forma Pauperis #2 . Plaintiff's Affidavit in Support of the Application indicates that a retainer fee was paid to Plaintiff's counsel in this case. In light of that retainer payment, the Court hereby DENIES Plaintiff's Motion to Proceed In Forma Pauperis #2 . The Court accordingly ORDERS that Plaintiff's counsel pay the required filing fee under 28 U.S.C. 1914, upon which payment the Clerk will docket the action and issue a summons for service upon Defendant. However, if additional financial information would change the Courts analysis of the situation, Plaintiff may file an amended motion and the Court may reconsider its ruling. ORDER- This matter comes before the Court on its own initiative. On June 22, 2023, a Summons was issued as to Defendant United States in this case #5 . However, Plaintiff had yet to pay the filing fee as required by 28 U.S.C. 1914. Additionally, the Court had yet to rule on Plaintiff's Motion to Proceed In Forma Pauperis #2 . Because Plaintiff has yet to pay the filing fee and the Court has not ruled on Plaintiff's pending motion, the Court hereby ORDERS Plaintiff to return the Summons issued on June 22, 2023, as unexecuted.
