MEMORANDUM ORDER - Plaintiff, a Virginia prisoner proceeding pro se, submitted this civil rights action. By Memorandum Opinion and Order entered on October 27, 2023, the Court denied Plaintiff's request to proceed in forma pauperis pursuant to 28 U.S.C. 1915(g) and dismissed the action without prejudice because Plaintiff had not paid the $402 filing fee. (ECF Nos. 6-8.) Plaintiff filed a Notice of Appeal and a Motion to Appoint Counsel on Appeal. (ECF Nos. 9-10.) To the extent that Plaintiff seeks the appointment of counsel for his appeal, he must direct that request to the United States Court of Appeals for the Fourth Circuit and not to this Court. ORDER - In accordance with the accompanying Memorandum Opinion, it is ORDERED that: Plaintiff's request to proceed in forma pauperis is DENIED; The action is DISMISSED WITHOUT PREJUDICE; If Plaintiff wishes to proceed with this action, he may submit a new complaint with the full $402.00 filing fee. The Court will process such a complaint as a new civil action; and, The Clerk is hereby DIRECTED to enter a final appealable Judgment in a Civil Case in favor of Defendant as a separate entry on the docket. The Court does not grant leave to amend, rendering this order final and appealable. Should Plaintiff desire to appeal a written notice of appeal must be filed with the Clerk of the Court within thirty (30) days of the date of entry hereof.
