Filing 2 ORDER (Denying Plaintiff's Motion to Proceed In Forma Pauperis). THIS MATTER is before the Court on Wesley Edward Smith, III's ("Plaintiff") pro se Application to Proceed In Forma Pauperis ("IFP"), filed on November 6, 2023, (ECF No. #1 ). Because it is impossible for an individual to subsist without any form of income or assistance whatsoever, the Court finds that it cannot construe the application as properly and accurately completed and, therefore, it cannot make any findings as to Plaintiff's ability to pay the required fees for this civil action. Accordingly, Plaintiff's Motion to Proceed In Forma Pauperis is DENIED WITHOUT PREJUDICE. The Clerk is DIRECTED to send pro se Plaintiff a copy of the long form application and a copy of this Order. Plaintiff is notified that, for the Court to consider his Complaint, he must properly and accurately complete and sign the Motion to Proceed In Forma Pauperis and Financial Affidavit or, in the alternative, pay the Court's filing fee, before Plaintiff's Complaint can be docketed. It is so ORDERED. Signed by Senior United States District Judge Henry E. Hudson on 11/16/2023. Order and In Forma Pauperis (long form) were mailed to the plaintiff. (sbea) |
