Filing 128 OPINION and ORDER directing that the Court RESERVES ruling with respect to the availability of an attorney's fee award. Defendant's motion for summary judgment (ECF No. 105) is DENIED except with respect to the availability of an attorney 039;s fee award. Plaintiff's motion for summary judgment (ECF No. 68) is GRANTED in part and DENIED in part; the motion is GRANTED with respect to the defendant's liability for violation of Section 307(a) of the Servicemembers Civil Relief Act and otherwise DENIED, except with respect to the availability of an attorney's fee award. The Clerk is DIRECTED to enter judgment for the plaintiff with respect to the defendant's liability under Count IV of the complaint, which allege s a violation of Section 307(a) of the Servicemembers Civil Relief Act. A determination as to any monetary damages shall be reserved for jury trial. The parties are ORDERED to SHOW CAUSE why summary judgment should not be granted to the plaintiff wit h respect to the defendant's liability under Count III of the complaint, which asserts a common-law claim for conversion.
