The motion to dismiss filed by Gayle is GRANTED as to all counts in the Complaint except the portion of Count Seven alleging § 1983 bystander l iability regarding Plaintiffs arrest; Gayles motion is DENIED with respect to such claim. Officer Briggs motion to dismiss is GRANTED with respect to Counts One and Two, DENIED as to Counts Three, Four, Five and Seven, and GRANTED in part and DENIED in part as to Count Six.
