Plaintiff has failed to allege sufficient facts to satisfy the first prong of the connection test, if taken as true, to establish federal maritime subject-matter jurisdiction; therefo re Defendant's Rule 12(b)(1) Motion to Dismiss for lack of subject-matter jurisdiction is GRANTED without prejudice.
