ORDER: Defendant's Partial Motion to Dismiss Under Federal Rule 12(b)(6) (ECF No. 4) is hereby GRANTED. Counts I and III of Plaintiffs Complaint are DISMISSED WITH PREJUDICE. Additionally, the claim for violation of the Virginia Human Rights Act, Va. Code 2.2-3900 et seq., contained in Count III of the Complaint, is DISMISSED WITH PREJUDICE. The Court retains jurisdiction over this Action to consider Plaintiffs claim under Title VII of the Civil Rights Act of 1964, 42 U.S.C. 2000e et seq., contained in Count II of the Complaint (ECF No. 1-1).
