November 13, 2020 Opinion or Order Filing 1 ORDER entered in 7:18-cv-00591 directing Clerk to file new case. This matter is before the court on Hawkins' motion to amend his complaint to add three new defendants and new claims concerning incidents that occurred after the filing of this action. Although Hawkins claims that the incidents described in his motion to amend were caused by the filing of this action, he alleges that they occurred at different facilities and all by people not named in this action. Inasmuch as these new claims and defendants are completely separate from the issues raised in this case, it is hereby ORDERED that Hawkins' motion to amend (ECF No. 31) is DENIED without prejudice. Because Hawkins' allegations may state cognizable federal claims, however, the Clerk is DIRECTED to file copies of the motion as two new and separate civil actions under 42 U.S.C. 1983, and the court will address the filings in those new cases by separate order. The first case should be against defendants Nelfrand and Forman concerning Hawkins' claims of due process violations and retaliation which arose at Sussex I State Prison; and the second case should be against defendant Stallard concerning Hawkins claims of retaliation and failure to protect which arose at Wallens Ridge State Prison.
