ORAL ORDER: Petitioner Jamal Kemo Saunders has moved for leave to file an amended petition for writ of habeas corpus under 28 U.S.C. 2254. A petition for writ of habeas corpus "may be amended or supplemented as provided in the rules of procedure applicable to civil actions." 28 U.S.C. 2242. The Federal Rules of Civil Procedure permit a party to amend a pleading "once as a matter of course within... 21 days after serving it." Fed. R. Civ. P. 15(a)(1)(A). Because Saunders's motion was filed within the 21-day period set forth in Rule 15, he is entitled to amend as a matter of course. Accordingly, the motion for leave to file an amended petition (ECF No. #8 ) is GRANTED. The Clerk is DIRECTED to file the amended petition (ECF No. #8 -1) and the exhibits attached to the original petition (ECF No. #1 -1) as a separate docket entry.
