Filing 65 ORDER ON CROSS-MOTIONS FOR SUMMARY JUDGMENT by Judge Barbara J. Rothstein. The facts are not in dispute and the Court finds as a matter of law that Defendant Goh is entitled to summary judgment confirming the decision of the arbitrator. The decision was issued in conformity with the requirements which the Supreme Court announced in Stolt-Nielsen and Oxford Health. The arbitrator unquestionably construed the Agreement and the result is thus entitled to be upheld. Plaintiff NCR'S 60 motion for summary judgment will be DENIED; Defendant Goh's 58 motion for summary judgment will be GRANTED. The arbitrator's ruling is hereby CONFIRMED. (PM) |
