ORDER granting in part and denying in part 16 Motion to Substitute Party. Accordingly, this Court ORDERS as follows: Count II of plaintiffs Amended Complaint 17 is hereby DISMISSED in its entirety; Count III of plaintiffs Amended Complaint 17 is hereby DISMISSED insofar as it raises claims for violations of the federal Constitution and West Virginia Constitution predicated upon false arrest; and Plaintiffs Motion for Substitution of Party 16 is hereby GRANTED as it pertains to all remaining claims.
