Filing 127 ORDER Granting in part and Denying in part 114 Defendant's Motion for Summary Judgment. The plaintiffs claims of ostensible agency, the defendants motion for summary judgment is GRANTED. The Court DENIES the defendants motion for summary jud gment to the extent that a triable issue of fact exists as to whether Dr. Cook was an actual agent of JMH. The Court is not convinced that the treatment Ramonas received fell to the level at which EMTALA was enacted to prevent. Accordingly, as to th is claim the motion for summary judgment is GRANTED. The Court finds Dr. Cooks diagnosis and treatment did not violate EMTALA. Accordingly, as to this claim the motion for summary judgment is GRANTED.
