The Court ORDERS the Commissioner's 16 Motion for Summary Judgment is GRANTED and the Plaintiff's 15 Motion for Summary Judgment is DENIED. The Court ORDERS that this matter be DISMISSED WITH PREJUDICE and STRICKEN from its active docket.
