MEMORANDUM OPINION AND ORDER GRANTING PLAINTIFF'S MOTION TO REMAND AND DENYING WITHOUT PREJUDICE DEFENDANTS' MOTION TO DISMISS: For the reasons stated, the plaintiff's 7 Motion to Remand is GRANTED. Accordingly, it is ORDERED that t his case be REMANDED to the Circuit Court of Brooke County, West Virginia. It is also ORDERED that defendants' 12 Motion to Dismiss is DENIED WITHOUT PREJUDICE to being raised in state court if appropriate.
