Filing 87 DECISION AND ORDER granting 48 Plaintiff Trafton's Motion for Partial Summary Judgment on the breach of contract claims; granting 49 Plaintiff Brinkley's Motion for Partial Summary Judgment on the breach of contract claims; granting in part and denying in part 59 Defendants' Motion for Summary Judgment, signed by Judge William C. Griesbach on 03/03/2010. The Defendants' motion for summary judgment is GRANTED in part, to the extent that breach of contract claims against George French are DISMISSED, as are any claims brought against French under Washington Statute § 49.48.010. Defendants are not entitled to summary judgment on the statutory claims and their motion in that respect is denied. The clerk will contact the parties to arrange a scheduling conference on the remaining statutory claims. See Decision and Order for full detail. (cc: all counsel) (Griesbach, William) |
Filing 65 ORDER granting in part 30 Motion for Sanctions, signed by Judge William C. Griesbach on 07-28-2009. Although the Plaintiffs ask that late-produced documents be barred, I conclude that the better course is to allow any further discovery that might be required and to leave open the possibility that Plaintiffs fees and expenses incurred in the taking of that additional discovery could be awarded. Defendants are to pay $2,500 to Plaintiffs as partial compensation for their responses to Plaintiffs valid discovery requests. See Order for full detail. (cc: all counsel) (Griesbach, William) |
Filing 36 ORDER regarding 30 7.4 Motion for Sanctions, signed by Judge William C. Griesbach on 04-16-2009. The Court will construe Defendants Response 34 as a request to convert the 30 Motion into a standard motion not subject to the limits of Rule 7.4. Defendant may respond to the motion 30 by May 5; Plaintiff may reply by May 19. (cc: all counsel)(Griesbach, William) |
Filing 28 ORDER GRANTING 24 Motion to Compel; GRANTING IN PART 16 Motion to Consolidate; Case Nos 08-C-99 and 08-C-642 are consolidated for purposes of discovery and motions involving common questions of law. The parties are to confer and submit a letter setting forth a proposed schedule to address matters that are consolidated, signed by Judge William C Griesbach on January 14, 2009.
