CTEs motion 64 is granted as to the Authoritys claims for amounts paid in excess of the NTE price and for legal fees and costs to pursue claims against the contractors. CTEs motion 64 is also granted as to the Authoritys tort claim for what it calls the deflection, concrete support, and leakage components of its damages. CTEs motion 64 is denied as to the Authoritys breach of contract claim for those components. The Authoritys motion for partial summary judgment 70 is DENIED. Likewise, its motion to amend the pleadings 109 is DENIED. The Clerk is directed to place this matter on the courts calendar for a Rule 16 conference to address further scheduling.
