ORDER granting 10 Motion to Remand to State Court, signed by Judge William C. Griesbach on 03/26/2010. The Court construe's the Motion to Remand-- as well as the amended state court complaint as a motion to dismiss plaintiff's federal cl aim. Accordingly, the federal claim is DISMISSED. Because the federal claim was the sole basis for this Court's subject matter jurisdiction, the motion to remand is GRANTED and the case is REMANDED to Waupaca County Circuit Court.
