ORDER granting in part and denying in part 8 Motion to Dismiss. AWDs motion to dismiss the complaint pursuant to Rule 12(b)(2) on the basis that personal jurisdiction is lacking is DENIED. AWDs motion to dismiss Burkes intentional misrepresentat ion claim for failure to comply with Rule 9(b) is GRANTED without prejudice. Burke will have thirty days to amend his complaint. AWDs response is due twenty days thereafter. The Clerk may set the matter on the Courts calendar for scheduling at this time.(cc: all counsel) (cav)
