Filing 35 ORDER signed by Chief Judge William C. Griesbach on 2/26/18. Sims' 33 MOTION for Leave to Proceed informa pauperis is DENIED as moot. Sims' action is DISMISSED pursuant to 28 U.S.C. §§ 1915(e)(2)(B) and 1915A(b)(1) for failure to state a claim. It is further ordered that the Clerk of Court document that Sims has incurred a "strike" under 28 U.S.C. § 1915(g). All claims as to Thomas are dismissed without prejudice in as much as he has not signed the complaint. The Clerk of Court is to enter judgment.
