DECISION AND ORDER signed by Judge Lynn Adelman on 11/5/15 that plaintiffs only need to prove that defendants intentionally misrepresented facts or acted in reckless disregard for the truth in the TPC requests, TPC hearing, or CHIPS petitions to prev ail on their procedural due process claim. This will entitle them to nominal damages. Further ordering that the question of whether the alleged misrepresentations caused the removal is relevant to compensatory damages and is thus a jury question. Further ordering that defendants unopposed motion to dismiss defendants Feiertag and Quam 74 is GRANTED. Further ordering that defendants objections in Gottliebs evidentiarydeposition are SUSTAINED.
