IT IS FURTHER ORDERED that the defendant's motion for reconsideration (ECF No. 41 ) is granted in part. The court's October 19 order (ECF No. 33 ) is hereby vacated with regard to its order for remand. IT IS FURTHER ORDERED that the motion for leave to amend (ECF No. 37 ) is granted in part. Plaintiffs Gebhardt's and Tyus's stand-alone disclosure claims are hereby dismissed. Tyus shall file a second amended complaint consistent with this order no later than January 13, 2017. IT IS FURTHER ORDERED that the defendant's motion to dismiss for failure to state a claim (ECF No. 21 ) is denied.
