DECISION AND ORDER signed by Judge Lynn Adelman on 9/20/16 that the Funds motion to dismiss 17 is GRANTED IN PART. The motion is granted insofar as Quads claims concerning the 2012 Assessment are dismissed without prejudice for want of an actual ca se or controversy, and its claim concerning the November 2015 request for information is dismissed without prejudice in favor of the coercive action pending in the Central District of California. In all other respects, the motion is denied, although I express no view on the merits of the Funds other grounds for dismissal. Further ordering that the Funds alternative motion to transfer this case to the Central District of California 29 is DENIED as MOOT. Further ordering that the Funds motion to file a supplemental request for judicial notice is GRANTED. Further ordering the Clerk of Court to enter final judgment. (cc: all counsel) (dm)
