TEXT ONLY ORDER signed by District Judge Lynn Adelman on 12/3/21 re #10 Letter from Plaintiff Regarding the Initial Partial Payment. The plaintiff says he does not have enough funds in his account to pay the $27.84 initial partial filing fee and requests "additional time to acquire the fees or assistance of some sort." He attached a trust account statement for October 2021, which shows an end balance of $0.00 in his regular account. But that statement, like the one he submitted on November 15, 2021, also shows several canteen and "Record Media" purchases. Although the plaintiff may decide how to spend the funds in his inmate account, the court need not waive the initial partial filing fee for a prisoner who chooses to spend his money on something other than his lawsuits. See Lindell v. McCaughtry, No. 01-C-209-C, 2004 WL 225074, *1 (W.D. Wis. Jan 23, 2004). I will GRANT the plaintiff's request for additional time to pay the initial partial filing fee. By February 4, 2022, he must pay the $27.84 initial partial filing fee or explain why he is not able to. (cc:all counsel and mailed to pro se party)(jad) |
