Filing 13 TEXT ONLY ORDER signed by Magistrate Judge William E Duffin on 12/16/2021, GRANTING plaintiff Fredrick Andrew Morris's motion for extension of time to pay the initial partial filing fee. #7 Morris now has until February 3, 2022 to pay the fee. Morris also filed a motion to compel discovery. Because Morris was incarcerated when he filed his complaint, the court must screen his complaint pursuant to the Prison Litigation Reform Act. Discovery does not begin until the court sets a scheduling order. The court does not set a scheduling order until after the court screens the complaint, which does not happen until Morris pays the initial partial filing fee. If the complaint survives screening, the court will then set a scheduling order after the defendants answer the complaint. As such, the court DENIES Morris's motion to compel discovery. #8 . Finally, Morris requests the court order a mental health examination pursuant to Fed. R. Civ. P. 35 because he feels he needs mental health services. Courts may order mental health examinations under Rule 35 when it needs the examination to shed light on a controversy related to health status in a case. Morris is not asking for such an exam and instead appears to be requesting a routine mental health exam. He needs to follow the procedures at his institution to be seen by the Health Services Unit to obtain such an exam. His motion for a court ordered mental health exam is DENIED. #9 .
