TEXT ONLY ORDER signed by Chief Judge Pamela Pepper on 7/22/2022.The court received a letter from the plaintiff, in which he says he is unable to pay the $1.53 initial partial filing fee in this case because he has no money in his regular institutional trust account and $0.24 in his release account. Dkt. No. 9. The plaintiff asks the court to dismiss this case so that he can re-file in the future, when he has the funds to pay for it. But the plaintiff then asks the court to allow him to proceed in the case without paying the initial partial filing fee. Because the plaintiff's letter is ambiguous, the court will require the plaintiff to clarify how he wishes to proceed with this case. The court ORDERS that by the end of the day on August 12, 2022, the plaintiff must file a letter telling the court whether he wishes to dismiss this case or whether he is requesting that he be allowed to proceed without prepaying an initial partial filing fee. The court reminds the plaintiff that if he dismisses the case, he will still owe the $350 filing fee. See Dkt. No. 8 at 4. If the plaintiff wishes to proceed without paying an initial partial filing fee, he must also file his latest trust account statement, showing that he is unable to pay the $1.53 initial partial filing fee. If the plaintiff fails to comply with this order, the court may dismiss the case for his failure to diligently pursue it. Note: there is no document associated with this text only order.
