April 14, 2023 Opinion or Order TEXT ONLY ORDER signed by Judge J.P. Stadtmueller on 4/14/2023. In light of #7 Defendants' unopposed motion to extend deadlines in this case, the motion is GRANTED as follows. If Defendants file a Motion to Vacate the Conditional Transfer Order in MDL No. 3052 and such motion is granted, Defendants' responsive pleading in this matter shall be due within thirty (30) days of entry of the order in MDL No. 3052. Defendants' request that the Court extend the parties' deadline to propose a schedule for holding for a Rule 26(f) conference, initial disclosures, and a discovery plan is granted subject to the following. The parties are advised that this branch of the Court typically does not hold scheduling conferences, instead requiring the parties to jointly prepare and submit a Rule 26(f) plan within two weeks of when all named parties have appeared, after which the Court issues a trial scheduling order. The Court also does not set discovery-related deadlines in its trial scheduling orders, instead generally leaving it to the parties to manage discovery consistent with the Federal Rules of Civil Procedure, this district's Local Rules, and their own stipulations. In other words, the deadlines for these discovery-related requirements may be obviated if this case proceeds in this Court. Further details will be laid out in a pretrial protocols order, which will issue in this action if the Defendants' above-referenced motion is granted and the action continues in this Court.
