Filing 44 JUDGMENT : Plaintiff is entitled to declaratory Judgment on its 1 Complaint as follows:(1) The Commercial General Liability policy at issue provides no policy benefits for the claims against Fredis Reyes arising out of the incident that occurred o n November 4, 2008 at the Audubon Pointe Apartments in Maumelle; (2) United Fire is under no obligation to provide a defense to Fredis Reyes as to any claim arising out of this incident ; and (3) United Fire is under no obligation to satisfy any j udgment entered against Fredis Reyes or to indemnify Fredis Reyes for any judgment rendered against him arising out of the incident. The 3 counterclaim for declaratory judgment filed by Judy and Claude Wheeler should be and is hereby dismissed with prejudice. The Clerk is directed to close the case. Signed by Judge James M.
