August 22, 2014 Opinion or Order Filing 74 OPINION AND ORDER granting in part and denying in part 42 Motion for Summary Judgment. Darren Smith's section 1981 claims against Captain Jeff Holmes and Lieutenant James Moore are dismissed. Smith's claim for continuing judicial oversig ht over the Arkansas Highway Police or the Arkansas Highway & Transportation Department is dismissed. Smith's Title VII discrimination and retaliation claims against the Arkansas Highway Police and his section 1981 claim against Chief Ron Burks and Major Paul Claunch in their individual and official capacities survive summary judgment and will proceed to trial.
