MINUTE ORDER. Pending before the Court is 58 defendants' motion for protective order. Defendants ask the Court to prohibit plaintiff from conducting discovery on the District's expenditure of resources in defense of this litigation. Specifically, plaintiff seeks "time sheets, billing statements, invoices, and the like, memorializing the time expended by attorneys and legal support staff in defense of this litigation," as well as "[a]ny and all records reflecting the value of time expended by attorneys and legal support staff in defense of this litigation." Defs.' Mot. at 2. Upon consideration of the motion, the response, the reply and the surreply thereto, and the applicable law, defendants' motion is GRANTED. As the parties are aware, "[a] request for attorney's fees should not result in a second major litigation[.]" Hensley v. Eckerhart, 461 U.S. 424, 437 (1983). Having carefully reviewed plaintiff's current motion for attorney fees and costs ("plaintiff's fee petition") and defendants' objections thereto, the Court concludes that a comparison of opposing counsel's time records and resulting fees would not assist the Court in its resolution of plaintiff's fee petition. While the Court does not foreclose the possibility of a plaintiff ever obtaining discovery from a defendant as to a fee petition, the Court finds such discovery unnecessary in this case. Accordingly, the Court GRANTS defendants' motion for a protective order. This determination is made, however, without prejudice to plaintiff's right to pursue such discovery, if, upon consideration of the briefing associated with plaintiff's revised fee petition, the Court concludes that a comparison of resources expended by the parties would assist the Court and not unduly burden defendants or the Court. In addition, pursuant to the status hearing held on May 26, 2010, the Court hereby enters the following briefing schedule for plaintiff's revised fee petition: plaintiff shall file his revised motion for attorneys fees and cost by no later than June 18, 2010; defendants shall file their response by no later than July 9, 2010; plaintiff shall file his reply by no later than July 30, 2010. Kenny A., 532 F.3d 1209 (11th Cir. 2008), to decide whether "a reasonable attorney's fee award under a federal fee-shifting statute [can] ever be enhanced based solely on quality of performance and results obtained when these factors already are included in the lodestar calculation." Because resolution of that issue will have a direct impact on the attorney fee request in Parker v.
