OPINION AND ORDER denying AS MOOT the States first 8 Motion to Dismiss for Failure to State a Claim and denying the States second 23 Motion to Dismiss for Failure to State a Claim ; granting Countys 19 Motion to Dismiss and granting i n part and denying in part the Clerks 21 Motion to Dismiss. The claim against the Clerk for monetary damages is DISMISSED without prejudice, but the claim against the Clerk for prospective relief survives. The claim against Porter County and th e claim against the Clerk of the Porter County Circuit Court for monetary damages are DISMISSED without prejudice. The case remains currently pending against the City of Portage, Indiana; the Chief of Police of Portage, Indiana; the Clerk of the Porter County Circuit Court (for prospective relief only); John Doe 1; John Doe 2; and John Doe 3.
