On its own motion pursuant to Fed. R. Civ. P. 42(a), the court CONSOLIDATES 3:14 CV 1613 with the 3:12 CV 186 , for all purposes. Because of that consolidation, Fir st Specialty's motion to dismiss 3:14 CV 1613 (DE # 10 ) is DENIED as moot. Pursuant to 28 U.S.C. § 636(b)(1)(A), Fed. R. Civ. P. 16, Fed. R. Civ. P. 72 (a), and Local Rule 72-1(b), the court hereby ORDERS that this case be assigned to Magistrate Judge Christopher A.
