Filing 66 ORDER - granting in part and denying in part 39 Defendant's Motion for Summary Judgment; We GRANT summary judgment in favor of Defendant Greenfield Police Department on all counts and DISMISS it from this suit. Summary Judgment is also GRANTED in favor of Defendant City of Greenfield on Plaintiff's excessive force claim brought pursuant to 42 U.S.C. 1983. Defendants' motion for summary judgment as to Plaintiff's remaining excessive force claims against Defendants Officer Caleb Freeman and City of Greenfield is hereby DENIED.
