Filing 101 MEMORANDUM OPINION AND ORDER REGARDING BENCH TRIAL ON THE MERITS - See order text for details. Because Schaffer's actions constitute arguable probable cause, and were not plainly incompetent, or a knowing violation of the law in his arre st of Leventhal, I find in this non-jury trial that Schaffer is entitle to qualified immunity. Therefore, Leventhal's 42 U.S.C. section 1983 claim against Schaffer for unlawful arrest is denied. This case is dismissed in it's entirety, and the clerk of court is directed to enter judgment accordingly. Signed by Judge Mark W Bennett on 09/09/2010. (order/NEF mailed to pro se plaintiff) (src) |

Signed by Judge Mark W Bennett on 3/24/09. (copy w/nef mailed to pro se plaintiff) (des) |
Filing 45 REPORT AND RECOMMENDATION RE: 23 Motion for Summary Judgment - It is recommended that unless any party files objections to the Report and Recommendation within ten days of the service of a copy of this Report and Recommendation, that the Defendants' Motion for Summary Judgment be granted and that the entire case be dismissed - Objection ddl 01/14/2009.
