September 9, 2010 Opinion or Order Filing 101 MEMORANDUM OPINION AND ORDER REGARDING BENCH TRIAL ON THE MERITS - See order text for details. Because Schaffer's actions constitute arguable probable cause, and were not plainly incompetent, or a knowing violation of the law in his arre st of Leventhal, I find in this non-jury trial that Schaffer is entitle to qualified immunity. Therefore, Leventhal's 42 U.S.C. section 1983 claim against Schaffer for unlawful arrest is denied.
