Filing 58 MEMORANDUM OPINION AND ORDER REGARDING BENCH TRIAL ON THE MERITS - The court grants Paul Dorrs request for declaratory relief and declares that Defendant Sheriff Webers denial of Pauls application for a concealed weapons permit was unconstitutional r etaliation for Pauls exercising his First Amendment rights of freedom of speech and freedom of association. The court also grants Pauls request for injunctive relief and orders Sheriff Weber to immediately issue Paul a nonprofessional permit to carry a weapon under Chapter 724 of the Iowa Code. Sheriff Weber is further ordered to enroll in, and successfully complete, a court approved course concerning the United States Constitution, and file proof of completion with this court, as discussed abov e proof of completion must be filed with this court by January 1, 2011. The court finds that Sheriff Weber did not retaliate against Alexander Dorr for exercising his rights under the First Amendment and, accordingly, orders no relief.
