REPORT AND RECOMMENDATIONS recommending granting 8 PARTIAL MOTION to Dismiss as follows. Count III (the Section 1983 claim alleging excessive force) would be the only claim currently pending, and it would be pending only against Erdmann and the Doe defendants. Counts I, II and V would be eligible to return to this case, against Erdmann and the Doe defendants, if Nunley isable to craft an amended complaint with additional factual allegations that meet the plausibility standard.
