Given the limited amount of time available for the Court to rule on the pending motion for preliminary injunction before the effective date of the proposed new public charge rule, the Plaintiffs' reply brief will be limited to 25 pages, exclusive of table of contents, citations, affidavits, or exhibits. This is five more pages than Local Rule 105.3 permits. With regard to further briefing in this case, the page limits in Local Rule 105.3 will apply unless a motion to exceed these limits is filed and granted in advance of the filing of a memorandum. Page extension motions filed with a memorandum that exceeds the page limits in the local rules will not be granted. Further, counsel are cautioned to restrict their use of overly long, multiple page, single spaced footnotes, which impermissibly extend the page limits allowed in the local rules. In addition, to assist counsel in focusing their presentations at the hearing scheduled for October 10, 2019, counsel should be prepared to focus on their strongest arguments with respect to the four elements that must exist before a preliminary injunction may be granted, and be prepared to identify by CM/ECF and page number the factual support for their positions. In addition, counsel will confer before the hearing in an effort to see whether they can agree to the language of an appropriately narrow injunction, in the event that the court determines that the issuance of a preliminary injunction is appropriate. If they cannot agree, Plaintiffs and Defendants each shall provide the court with the language of an injunction that they propose, without further argument or citation of authority accompanying the proposed language.
