MEMORANDUM OPINION AND ORDER granting defendant's 5 Motion to Dismiss as follows: 1) Plaintiffs' claims for breach of contract and breach of fiduciary duty are dismissed with prejudice; 2) Plaintiffs' claims for unlawful an d deceptive trade practices and unjust enrichment are dismissed without prejudice; 3) Plaintiffs have thirty (30) days to file an amended complaint addressing the noted shortcomings in their claims alleging unlawful trade practices and unjust enrichment; 4) Plaintiffs complaint will be dismissed with prejudice if an amended complaint is not timely filed.(Written Opinion).
