MEMORANDUM AND ORDER that the magistrates judge's 18 Findings and Recommendation, as modified by the foregoing memorandum, are adopted. The defendant's 23 Objection to Findings and Recommendation is denied. The plaintiff's [11 ] Motion to Remand is granted, and the case is remanded to the District Court of Scotts Bluff County, Nebraska. The plaintiff's 10 Motion to Change Venue is denied as moot. The clerk of the court shall mail a certified copy of this order, and of the magistrate judge's findings and recommendation, to the District Court of Scotts Bluff County, Nebraska, and may take any other action necessary to effectuate the remand.
